The H-1B visa is the most famous US work visa for skilled professionals — especially in tech, engineering, and finance. It's also one of the most competitive, because demand far exceeds the annual limit. Here's how it really works in 2026.

What is the H-1B?

The H-1B is a non-immigrant, employer-sponsored visa for "specialty occupations" — jobs that normally require at least a bachelor's degree. A US company sponsors you for up to three years, extendable to a maximum of six in most cases. It's capped at 85,000 new slots per year (including 20,000 reserved for US master's degree holders).

The lottery

Because applications exceed the cap, the H-1B uses a lottery. Employers first submit an electronic registration; if selected, they then file the full petition. After recent rule changes (a "beneficiary-centric" system that reduced gaming), eligible registrations dropped significantly — which slightly improved genuine applicants' odds, though it remains very competitive.

Main requirements

2026 update: Since late 2025, the US State Department added scrutiny of H-1B and H-4 applicants' online presence — applicants may need to disclose social media handles and keep those profiles public during adjudication. Keep your online profiles consistent with your resume and petition.

The path to a green card

Many people use the H-1B as a stepping stone. While on H-1B, your employer can sponsor you for a green card (usually EB-2 or EB-3). The H-1B is "dual intent," meaning you're allowed to pursue permanent residency while holding it — a big advantage over many other work visas.

Alternatives to the H-1B

If the lottery doesn't work out, strong alternatives exist for the right profiles: O-1 (extraordinary ability), EB-1A and NIW (self-petition green cards for high achievers), L-1 (intra-company transfer), and STEM-OPT for graduates. These need strong evidence but skip the lottery.

Honest advice

The H-1B rewards genuinely skilled candidates with real degrees and employers who value them. Focus on building skills that US companies want, a clean professional online presence, and a strong CV. No agent can "guarantee" you an H-1B — the lottery is run by the US government.
